Terms & Conditions

CUSTOMERS

These Terms and Conditions (the “Terms”) govern your access to and use of the Tiffit

website, mobile application, and any related services (together, the “Platform”).

By accessing, browsing, registering on, or using the Platform, you confirm that you have

read, understood, and agree to be legally bound by these Terms. If you do not agree, you

must not access or use the Platform.

1. Definitions and Interpretation

In these Terms:

• “Tiffit”, “we”, “us”, or “our” means Tiffit Ltd (or such trading entity as may

operate the Platform from time to time).

• “Cook”, “Seller”,

“Homecook”

, or “Cookpreneur” means an independent

third-party individual or business offering food for sale via the Platform.

• “Customer” or “you” means any individual who accesses, browses, or

purchases food through the Platform.

• “Delivery Partner”,

“Area Manager”

,

“Franchisee” means an independent

third-party providing delivery services.

• “Content” means all text, images, videos, data, reviews, messages, or other

material available on the Platform.

Headings are for convenience only and do not affect interpretation.

2. Platform-Only Marketplace Role
Tiffit operates solely as a technology marketplace platform that enables Customers to
discover and purchase food from independent Cooks.
For the avoidance of doubt:
• Tiffit does not prepare, cook, store, package, label, handle, transport, or sell food
• Tiffit does not operate kitchens or food premises
• Tiffit is not a Food Business Operator
• Tiffit does not act as a seller, reseller, distributor, or agent for food
Under the Food Safety Act 1990, the Food Hygiene (England) Regulations 2013, and
any successor legislation, each Cook acts as an independent Food Business Operator
and bears sole and exclusive responsibility for compliance with all applicable food
safety and hygiene laws.

3. Responsibility for Food
All responsibility for food listed, offered, sold, or supplied via the Platform lies entirely
and exclusively with the relevant Cook, including (without limitation):
• Food safety and hygiene standards
• Ingredient sourcing and preparation
• Allergen identification and disclosure
• Packaging, storage, and handover
• Compliance with all applicable UK food laws and regulations
Tiffit accepts no responsibility or liability for any food consumed, purchased, or
otherwise obtained through the Platform.

4. Certificates, Registration and Onboarding Checks
Tiffit may, at its discretion, request that Cooks upload documentation (including food
hygiene certificates or local authority registration confirmations) during onboarding.
Such checks are conducted solely for internal eligibility and platform access
purposes.
You acknowledge and agree that:
• Uploading documentation does not constitute inspection, approval, verification,
or certification
• Tiffit does not guarantee accuracy, validity, or continued compliance
• No regulatory compliance obligation transfers to Tiffit
• Tiffit does not undertake ongoing monitoring
Responsibility for legal compliance remains with the Cook at all times, including after
onboarding.


5. No Monitoring, Control or Supervision
You acknowledge and agree that:
• Tiffit does not supervise food preparation
• Tiffit does not control kitchen conditions
• Tiffit does not monitor hygiene, cleanliness, or cooking practices
• Tiffit has no practical ability to oversee day-to-day cooking operations
Any assumption of control, oversight, or supervision by Tiffit is expressly disclaimed.

6. Domestic Kitchens and Risk Acknowledgement
Food sold via the Platform may be prepared in domestic or non-commercial kitchens.
By placing an order, Customers acknowledge that:
• Domestic kitchens may not be inspected to commercial standards
• Home-prepared food carries inherent risks
• They knowingly and voluntarily assume such risks


7. Allergens, Special Instructions and User Conduct
7.1 Allergens and Dietary Information
All allergen, ingredient, and dietary information is provided solely by the Cook.
Tiffit:
• Does not verify allergen information
• Makes no warranties as to accuracy or completeness
Customers with allergies or dietary requirements must contact the Cook directly prior
to ordering. Tiffit accepts no liability for allergic reactions, undeclared allergens, or
inaccurate disclosures.
7.2 Special Instructions
Customers may submit special requests. You acknowledge that:
• Food is prepared by independent home cooks
• Cooks may have limited ability to accommodate requests
• Cooks may accept or reject requests at their discretion
Tiffit does not guarantee compliance with special instructions and is not responsible for
any Cook’s decision.
7.3 Acceptable Use
You agree not to:
• Use abusive, offensive, threatening, or discriminatory language
• Harass or intimidate other users
• Misuse messaging, reviews, or reporting tools
• Submit misleading, harmful, or unlawful content
Tiffit reserves the right to remove content or suspend accounts without notice.

 

8. Orders, Payments and Refunds
• Payments may be processed through the Platform for convenience only
• Each food sale constitutes a direct contract between Customer and Cook
• Refunds, cancellations, and disputes are matters solely between Customer and
Cook
Tiffit does not guarantee refunds. Any assistance provided is discretionary and does not
create an obligation.


9. Delivery Services
Delivery services may be provided by independent Delivery Partners.
Neither Tiffit nor Delivery Partners:
• Inspect food
• Open packaging
• Verify food quality or safety
Delivery Partners are independent contractors and not employees, agents, or
representatives of Tiffit.


10. No Agency, Partnership or Employment
Nothing in these Terms creates any partnership, agency, joint venture, or employment
relationship between Tiffit and any Cook, Customer, or Delivery Partner.

 

11. Limitation of Liability
To the fullest extent permitted by law:
• Tiffit excludes all liability for food-related issues
• Tiffit is not liable for illness, injury, allergic reactions, or contamination
• Tiffit is not liable for indirect or consequential losses
Where liability cannot be excluded, Tiffit’s total liability is limited to the platform fee
charged for the relevant transaction.

 

12. Indemnity
Cooks agree to fully indemnify and hold harmless Tiffit from all claims, losses, damages,
costs, and legal proceedings arising from:
• Food prepared or sold
• Breach of food laws
• Customer complaints
• Regulatory or enforcement action


13. No Reliance
Users confirm that they do not rely on:
• Onboarding checks
• Certificate uploads
• Platform listings
as evidence of safety, legality, or compliance.


14. Suspension and Termination
Tiffit may suspend or terminate access to the Platform at its discretion and without notice
where misuse or breach is suspected.

 

15. Intellectual Property
All Platform content, branding, and technology remain the property of Tiffit or its
licensors. No rights are granted beyond those necessary to use the Platform.

 

16. Data Protection and GDPR
Tiffit processes personal data in accordance with the UK GDPR and the Data Protection
Act 2018.
• Tiffit acts as a data controller for Platform-related data
• Cooks and Delivery Partners act as independent data controllers for any
personal data they receive
Tiffit is not responsible for the data handling practices of third parties. Full details are set
out in the Privacy Policy, which forms part of these Terms.

 

17. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and
Wales have exclusive jurisdiction.

 

18. Changes to These Terms
Tiffit may amend these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.

COOKS

These Cook Terms & Conditions (“Cook Terms”) govern your access to and use of the Tiffit

platform as a food seller (“Cook”).

By registering, listing food, or accepting orders on Tiffit, you agree to be legally bound by

these Cook Terms. If you do not agree, you must not use the Platform.

1. Your Role as a Cook

By using Tiffit, you confirm that:

• You operate as an independent food seller

• You are a Food Business Operator under applicable food laws

• You are not an employee, agent, partner, or representative of Tiffit

Tiffit acts only as a technology platform enabling you to sell food to Customers.

2. Legal & Regulatory Compliance

You are solely responsible for complying with all laws and regulations applicable to your

location, including but not limited to:

• Food Safety Act 1990

• Food Hygiene (England) Regulations 2013 (or local equivalents)

• Food Information Regulations 2014 (allergens)

• Local authority food business registration requirements

Tiffit does not verify or guarantee your compliance.

3. Food Safety, Hygiene & Allergens

You are solely and fully responsible for:

• Food hygiene and cleanliness

• Safe food handling, preparation, storage, and packaging

• Ensuring food is fit for human consumption

• Declaring accurate and complete allergen information

• Preventing cross-contamination

All allergen and ingredient information provided on the Platform must be true, accurate,

and up to date.

Any illness, injury, allergic reaction, or complaint arising from your food is entirely your

responsibility.

4. Certificates & Platform Checks

Tiffit may, at its discretion, require you to upload documentation such as:

• Food hygiene certificates

• Local authority food business registration confirmations

In addition, Tiffit may conduct food safety or hygiene inspections for:

• Internal platform standards

• Risk assessment

• Quality control

• Trust and safety purposes

Important Legal Clarifications

You expressly acknowledge and agree that:• Any inspection conducted by Tiffit is for internal platform use only

• Such inspections do not constitute legal approval, certification, or

endorsement

• Inspections are not regulatory or statutory inspections

• Inspections cannot be relied upon by you, Customers, regulators, or third parties

• Inspections do not confirm compliance with food safety laws

• Inspections do not create any ongoing duty to monitor or re-inspect

• Responsibility for legal compliance remains solely with you at all times

Passing an inspection or onboarding process does not remove, reduce, or transfer your

legal obligations.

5. Payments & Payout Timing

Payments collected via the Platform are processed for convenience only.

You acknowledge and agree that:

• Payouts will be initiated no earlier than 3 days after order completion

• Payouts may take up to 30 days to reflect in your bank account

• Delays may occur due to payment processors, banks, disputes, or compliance

checks

• Tiffit does not guarantee payout timelines

Tiffit is not liable for delays outside its control.

6. Platform Fees

Tiffit may deduct platform fees, delivery charges, refunds, or adjustments before

payouts, as communicated separately.

7. Reviews, Ratings & Quality Control

Customers may leave reviews and ratings based on their experience.

You acknowledge that:

• Customer reviews cannot be edited, removed, or manipulated

• Ratings are final and reflect customer opinion

• If your average rating falls below 3.0, Tiffit may:

o Suspend your account, or

o Permanently remove you from the Platform

Tiffit has sole discretion in enforcement decisions.

8. Branding & Use of Name

You may not:

• Sell or distribute food using Tiffit branding outside the Platform

• Use Tiffit’s name, logo, packaging, or materials independently

• Represent yourself as acting on behalf of Tiffit

All branding rights remain the exclusive property of Tiffit.

Content Ownership & Licence

Any content uploaded, submitted, posted, or otherwise made available by you on the

Tiffit platform, including but not limited to:

• Dish names

• Menus

• Prices

• Descriptions

• Images, photos, videos

• Allergen information

• Availability data

• Any other text or media

(collectively, “Cook Content”)

shall become the property of Tiffit upon submission, to the maximum extent permitted

by law.

Where ownership transfer is not legally enforceable, you grant Tiffit a perpetual,

irrevocable, worldwide, royalty-free, transferable licence to:

• Use, store, display, reproduce, modify, adapt, publish, and distribute the Cook

Content

• Use the Cook Content for platform operations, marketing, analytics, product

improvement, and promotional purposes

• Continue using the Cook Content even after your account is suspended or

terminated

You waive any moral rights you may have in the Cook Content, to the extent permitted by

law.

9. Delivery & Handover

You are responsible for ensuring food is safely prepared and packaged prior to handover.

You acknowledge that:

• Delivery may be performed by independent delivery partners

• Tiffit and delivery partners do not inspect food

• Responsibility for food safety remains with you until handover

10. Taxes & Financial Obligations

You are solely responsible for:

• Declaring income earned via Tiffit

• Paying all applicable taxes, VAT, National Insurance, or duties

• Maintaining proper financial records

Tiffit has no responsibility for your tax obligations.

11. No Employment or Agency Relationship

Nothing in these Terms creates:

• An employment relationship

• A worker or contractor relationship

• Any entitlement to employment benefits

You operate independently and at your own risk.

12. Suspension & Termination

Tiffit may suspend or permanently ban your account at any time, with or without notice,

including (but not limited to):

• Breach of these Terms

• Food safety concerns

• Customer complaints

• Low ratings• Legal or regulatory risks

• Reputational harm to the Platform

Termination does not remove your legal responsibilities for past orders.

13. Indemnity (Critical Clause)

You agree to fully indemnify and hold harmless Tiffit, its directors, employees, and

partners against:

• Food-related claims or complaints

• Illness, injury, or allergic reactions

• Regulatory action or fines

• Legal costs or damages

Arising from your food, conduct, or non-compliance.

14. Limitation of Tiffit’s Liability

To the fullest extent permitted by law:

• Tiffit excludes all liability for your food or actions

• Tiffit shall not be liable for loss of income, reputation, or business

• Any liability, if unavoidable, is limited to fees charged by Tiffit to you in the

preceding transaction

15. No Reliance

You agree that you do not rely on:

• Platform onboarding

• Document uploads

• Internal checks

As evidence of legality, safety, or compliance.

16. Governing Law & Jurisdiction

These Cook Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction.

17. Changes to Terms

Tiffit may update these Cook Terms at any time. Continued use of the Platform

constitutes acceptance of updated terms.

PRIVACY POLICY & GDPR

1. INTRODUCTION, PURPOSE AND LEGAL BASIS

This Data Privacy & Protection Policy (the “Policy”) explains in detail how Tiffit Ltd(“Tiffit”, “we”, “us”, “our”) collects, uses, stores, discloses, and otherwise processes personal data when individuals interact with the Tiffit platform, whether as Customers, Cooks, Area Managers, delivery partners, business contacts, or visitors to our website or mobile application (together, the “Platform”).

This Policy is drafted to ensure transparency and compliance with:

• the UK General Data Protection Regulation (UK GDPR); and

• the Data Protection Act 2018.

This Policy applies to all personal data processed by Tiffit in connection with the operation of the Platform, except where we expressly state that we act as a data processor on behalf of another party.

 

2. DATA CONTROLLER STATUS AND ROLE CLARITY

2.1 Sole data controller

Except where expressly stated otherwise in writing, Tiffit acts as the sole data controller in respect of all personal data processed through the Platform. Tiffit alone determines the purposes for which personal data is processed and the means by which such processing takes place.

2.2 Cooks

Cooks using the Platform are not joint data controllers in respect of Platform data. Cooks access personal data strictly through the Platform and only to the extent necessary to fulfil Orders and comply with applicable food safety or legal obligations. Where a Cook processes personal data independently outside the Platform (for example, for tax records or local authority compliance), the Cook acts as an independent data controller for that separate processing only.

2.3 Area Managers

Area Managers act as data processors on behalf of Tiffit. They process personal data strictly in accordance with Tiffit’s documented instructions and solely for operational purposes such as inspections, hand-over verification, and delivery coordination. Area Managers have no authority to determine the purposes or means of processing personal data.

 

3. WHO WE ARE AND HOW TO CONTACT US

Where required by law, Tiffit will appoint a Data Protection Officer (DPO). All data protection enquiries are handled confidentially and in accordance with statutory time limits.

• customer complaints, refunds, and dispute records.

Tiffit does not store full payment card details. Payments are processed by authorised third-party payment service providers.

4.4 Platform usage and technical data

Automatically collected data may include:

• IP address;

• device identifiers;

• operating system and browser type;

• log files, access times, and interaction data;

• analytics relating to Platform usage.

4.5 Communications and support data

Including:

• messages sent through the Platform;

• communications with customer support;

• feedback, reviews, and survey responses.

4.6 Analytics and performance data

Including aggregated and pseudonymised data relating to:

• dish popularity;

• order volumes;

• performance metrics;

• service quality indicators.

Such data is used to provide insights to Cooks and Area Managers without identifying individual Customers.

 

5. PURPOSES AND LAWFUL BASES FOR PROCESSING

We process personal data only where permitted under UK GDPR and only for defined purposes.

5.1 Performance of a contract

We process personal data where necessary to:

• create and manage user accounts;

• facilitate Orders and deliveries;

• process payments and refunds;

• provide customer and operational support;

• enforce contractual terms.

5.2 Compliance with legal obligations

We process personal data to comply with legal requirements, including:

• food safety and trading standards obligations;

• accounting and tax laws;

• responding to lawful requests from courts, regulators, or public authorities.

5.3 Legitimate interests

We may process personal data where necessary for our legitimate interests, provided those interests are not overridden by your rights and freedoms. These interests include:

• maintaining and improving Platform functionality;

• preventing fraud and abuse;

• ensuring quality control and operational integrity;

• analysing aggregated usage trends;

• protecting Tiffit, Platform users, and the public.

5.4 Consent

Where required, we rely on your explicit consent, for example for:

• marketing communications;

• participation in optional surveys or promotions.

You may withdraw consent at any time.

• enable essential Platform functionality;

7.2 Area Managers

Area Managers receive limited personal data strictly necessary to perform their operational tasks and act as data processors on behalf of Tiffit.

7.3 Legal and regulatory disclosure

We may disclose personal data where required to:

• comply with legal obligations;

• respond to lawful requests;

• protect rights, safety, and property.

7.4 Corporate transactions

In the event of a merger, acquisition, restructuring, or sale of assets, personal data may be transferred subject to applicable safeguards.

Where personal data is transferred outside the UK, we ensure appropriate safeguards are in place, including adequacy regulations or approved contractual mechanisms.

Retention periods vary by data category and legal requirement. Data no longer required is securely deleted or anonymised.

13. THIRD-PARTY LINKS

The Platform may contain links to third-party services. We are not responsible for their privacy practices.

 

14. CHANGES TO THIS POLICY

We may update this Policy to reflect changes in law, technology, or business practices. Material changes will be communicated where required.
